CapitalTM Windows and Doors Limited Manufacturer's Warranty
THE MANUFACTURERS' products are fully warranted against defects in workmanship and materials under normal use and service as indicated below. The manufacturer agrees to repair or replace AT THE FACTORY, FREE OF CHARGE, any returned product that is found to be defective. The guarantee does not cover glass or screen breakage for any cause whatsoever. WARRANTY IS VOID IF PRODUCTS ORIGINAL DESIGN, FINISH, IS ALTERED OR DEFACED IN ANY WAY, SUCH AS PAINTED, OTHER THAN BY THE MANUFACTURERS' TRAINED PERSONNEL. SERVICE CALLS TO THE HOME WILL BE AT THE PREVAILING RATE. THE PRODUCTS COVERED BY THIS WARRANTY ARE INTENDED TO BE INSTALLED IN A SINGLE DWELLING RESIDENTIAL ENVIRONMENT.
THE MANUFACTURER warranty of the product shall extend for a stated period of time after the date of manufacture. If THE MANUFACTURER elects to supply another product as described below, the warranty on said product will extend for the balance of the original stated period.
THE MANUFACTURER MAKES NO OTHER EXPRESS OR IMPLIED REPRESENTATION OR WARRANTY OF ANY KIND REGARDING THE PRODUCT, WHETHER AS TO MERCHANT ABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE OR ANY OTHER MATTER. THERE ARE NO OTHER WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. In particular, THE MANUFACTURER assumes no responsibility for glass breakage, improper usage, failure of product on account of faulty installation or building construction or design, installation of the product in sloped glazing, improper handling, failure to follow THE MANUFACTURERS' instructions regarding the product, or if the unit is subject to stresses resulting from localized application of heat which caused excess temperature differentials, or if strain is applied to unit by movement of the building. Special care should be used to remove a sash or glass from a window or door.
In the event that the product fails to conform to THE MANUFACTURERS' warranty described above, THE MANUFACTURER will at its option, furnish the purchaser with another product F. O. B. THE MANUFACTURER. THE MANUFACTURER WILL BEAR NO OTHER EXPENSE, SUCH AS LABOR COSTS OF ANY KIND AND PURCHASER'S EXCLUSIVE REMEDY IN LIEU OF ALL INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING IN THE CASE OF NEGLIGENCE, IS LIMITED TO FURNISHING OF ANOTHER PRODUCT AS HERETOFORE DESCRIBED.
FOR WINDOW PRODUCTS WITH LIFETIME WARRANTY (BASIC WINDOW UNIT). The rigid vinyl in the window is warranted against chipping, cracking, peeling, pitting or blistering, for as long as you own and reside in the house in which these products were installed. This limited warranty does not apply to any damage caused by improper installation, accident, fire, flood, explosion, misuse, abuse, vandalism, or other external forces. WARRANT IS VOID IF PRODUCTS ORIGINAL DESIGN, FINISH IS ALTERED OR DEFACED IN ANY WAY, SUCH AS PAINTED, OTHER THAN BY THE MANUFACTURERS' TRAINED PERSONNEL. SERVICE CALLS TO THE HOME WILL BE MADE AT THE PREVAILING RATE. NOTE: ALL WARRANTIES ARE NULL AND VOID IF ANY VERTICAL HOLES ARE PUT INTO THE WINDOW SILL AREA OF ANY M.I. OR CAPITOL WINDOWS.
Moving Parts - Moving parts, such as balances that are used on hung windows and locking mechanisms used in all windows are warranted for one year. The limited warranty does not apply to any damage caused by improper installation, accident, fire, flood, explosion, misuse, abuse, vandalism, or other external forces.
Fiberglass Screens - The materials used in manufacturing screens are warranted for as long as you own and reside in the house in which the products were installed. This warranty does not apply to any damage caused by improper installation, accident, fire, flood, explosion, misuse, abuse, vandalism, or external forces, and the warranty shall be limited to providing you with new screen material and/or frames or spline for any manufacturing defect in the screen.
Insulated Glass Unit - 10 years from date of installation, the insulating glass units will be free of obstruction of a vision as a result of dust or film formation on the internal surfaces caused by failure of the hermetic seal due to faulty manufacture under conditions of normal use and service. THE MANUFACTURER will assume 100% of the cost of the replacement glass within the first ten years. The foregoing warranty applicable to insulating glass will be void under any of the following circumstances: (1) Damage during handling or installation: (2) Subjection to stresses arising from heat application causing temperature differentials over the glass surfaces or edges and/or stresses caused by building settlement or movement. (3) Installation at altitudes in excess of 6,000 feet. (Unless ordered with a breather tube) NOTE: Humidity within the house or building area, and exterior temperature differential may as a natural result cause condensation on windows which does not indicate a defect in the window and would not be included in this warranty. THERE ARE NO WARRANTIES, EXPRESSED OR IMPLIED, AS TO GLASS THAT IS BROKEN BY ANY CAUSE OR FOR ANY REASON. Replacement material may be picked up at THE MANUFACTURERS factory, or at any designated distribution point.
Sales Of All Windows - THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED INCLUDING THE WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR PARTICULAR PURPOSE. Enforceability of this warranty is limited to the original consumer purchaser. UNDER NO CIRCUMSTANCES IS THE MANUFACTURER TO BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING, BUT NOT LIMITED TO DAMAGE OR LOSS OF OTHER PROPERTY OR EQUIPMENT. This warranty covers only manufacturing defects and does not include defects or damages caused by normal deterioration, accidents, fire, floods, acts of God, faulty installation, vandalism, abuse, neglect, or failure to perform reasonable and necessary maintenance. This warranty covers material only and THE MANUFACTURER does not assume any expense involved with the removal or reinstallation of any replacement parts. In the event that THE MANUFACTURERS' obligation under this warranty is sought, the part or parts that allege do not conform to this warranty must be shipped to THE MANUFACTURER transportation charges pre-paid. THE MANUFACTURER will at its option replace or repair without charge any defective part of comparable component, excluding glass (see glass warranty). The original warranty period shall not be extended by any repair or replacement and the remaining warranty time period shall continue in effect. THE MANUFACTURER reserves the right to discontinue the model manufactured under this warranty or change any part or component of the same and shall have the right to substitute a different model, part or component designed solely by THE MANUFACTURER to be of equal quality or price. Color variance may occur between replacement parts and weathered original material, which would not indicate any defect.
If any part of this warranty shall be held void or unenforceable in any State in the United States, the remaining portions shall nonetheless continue in full force and effect. This warranty will become effective upon certification by the DISTRIBUTORS authorized DEALER that the installation of the windows has been completed at the premises or original purchaser of windows.
Condensation - Condensation on any windows is the natural result of excessive moisture in the house, and does not indicate a defective or faulty installation. Additional information concerning condensation is available upon request.
Color - The white and beige vinyl will maintain its manufactured color closely as it ages; however, atmospheric pollution and residues deposited on the windows can temporarily discolor it. Mild soaps or detergents are usually all that are necessary to restore its brilliant manufactured color. Bronze vinyl is not covered under this warranty.
Caulking - On some installations caulking is used to seal the frames or trim packages against water or air penetration. Caulking is not considered part of the product, and therefore is not covered under this warranty. Caulking is normally considered a maintenance responsibility of the homeowner. Some states do not allow limitations on how long an implied warranty lasts, or the exclusions limitation of incidental or consequential damages, so that the above limitations or exclusions may not apply to you.
Special Note: This warranty is valid in the United States and Canada. All claims must include a copy of original sales receipt or proof of purchase.
